TERMS AND CONDITIONS

1. SCOPE AND APPLICATION
These Terms and Conditions (hereinafter referred to as "Terms") shall govern all accommodation agreements and related contracts entered into between IBFW Hospitality Services Private Limited (hereinafter referred to as "the Company") and guests, including those utilizing rooms for business purposes within the day. Any matters not stipulated herein shall be governed by applicable laws, regulations, and generally established customs of the hospitality industry in India. The provisions contained herein shall be binding upon all parties availing the services of the Company.
2. ACCOMMODATION APPLICATION AND AGREEMENT
For the purpose of securing accommodation, the applicant shall furnish to the Company complete and accurate information including, but not limited to, the name, address, contact number, and email address of the guest. Furthermore, the applicant shall specify the date of stay, estimated time of arrival, and shall acknowledge the accommodation charges as per the prevailing rate schedule. The Company reserves the right to request additional information as deemed necessary for the completion of the booking process. Upon acceptance of the accommodation application by the Company, the guest shall remit a deposit in such amount as specified by the Company within the stipulated deadline. Such deposit shall be appropriated first towards the final accommodation charges and thereafter towards any applicable cancellation penalties or damages that may arise during the course of stay. The accommodation agreement shall be deemed to be concluded and legally binding upon the Company's acceptance of the application and receipt of the requisite deposit. In the event the guest fails to remit the deposit within the specified deadline, the agreement shall stand automatically void without further notice
3. CHECK-IN AND REGISTRATION
The standard check-in time at the Company's establishments shall commence at 1400 hours (Indian Standard Time) and the check-out time shall be 1200 hours (Indian Standard Time). The Company may, at its discretion and subject to availability, provide early check-in and late check-out facilities upon payment of additional charges as prescribed from time to time. At the time of check-in, all guests shall be required to complete the registration process and present valid government-issued photo identification. In the case of international guests, it shall be mandatory to present a valid passport along with appropriate visa documentation. The Company shall accept as valid identification any of the following documents: passport, Aadhaar Card, Driving License, or Voter ID Card. For the avoidance of doubt, it is hereby clarified that PAN cards shall not be accepted as valid identification for check-in purposes.
4. USAGE OF ROOMS AND FACILITIES
The guest shall utilize the rooms and facilities strictly in accordance with their intended purposes and in compliance with all applicable laws and regulations. The Company expressly prohibits the following activities within its premises: utilization of rooms for purposes other than accommodation without prior written authorization; smoking in designated non-smoking rooms, including the use of electronic cigarettes and heat-not-burn devices; use of open flames or unauthorized cooking equipment; modifications, alterations, or tampering with room fixtures or equipment; unauthorized entry into staff-only areas; and any activities that may cause disturbance, inconvenience, or annoyance to other guests. In the event of smoking in designated non-smoking rooms, the Company shall levy a cleaning and compensation charge of Rupees Ten Thousand Only (Rs. 1,000/-) in addition to the applicable room charges. Furthermore, guests shall exercise due care in safeguarding room keys, and in the event of loss or damage to the same, shall be liable to pay a replacement charge of Rupees One Thousand Only (Rs. 1,000/-).
5. PROHIBITED ITEMS
The Company, in furtherance of maintaining safety, security, and comfort of all guests, hereby prohibits the bringing into or storage within its premises of the following items: animals and pets, save and except for certified service animals; inflammable, explosive, or hazardous materials of any nature whatsoever; firearms, weapons, or dangerous implements; illegal substances or contraband as defined under applicable laws; items emitting strong or offensive odors that may cause discomfort to other guests; and excessive luggage or items that may impede emergency evacuation procedures. The Company reserves the right to inspect and refuse entry of any items deemed inappropriate or hazardous.
6. GUEST CONDUCT AND BEHAVIOR
All guests shall maintain appropriate conduct and decorum within the premises of the Company at all times. The Company expressly prohibits and shall not tolerate any of the following activities: gambling or engagement in immoral activities; conducting unauthorized business activities or solicitation of any kind; undertaking political or religious activities without prior written permission; photography or filming for commercial purposes without proper authorization; threatening, harassing, or disturbing behaviour directed towards staff members or other guests; and any activities that violate public order or safety regulations. The Company hereby reserves the right, to be exercised at its sole discretion, to refuse service or terminate the accommodation of any guest engaging in prohibited behaviour as enumerated herein. Such termination may be effected without prior notice and without any obligation for refund or compensation on the part of the Company.
7. HOUSEKEEPING AND MAINTENANCE
The Company shall provide housekeeping services upon request by the guest during their period of stay. Notwithstanding any preferences expressed by the guest regarding housekeeping frequency, the Company shall undertake mandatory housekeeping services every sixth night of continuous occupancy for the purpose of maintaining requisite hygiene and sanitation standards. Such mandatory service shall not be subject to waiver or refusal by the guest. Furthermore, the Company hereby reserves the right to enter any occupied room for the purposes of conducting maintenance works, carrying out statutory inspections, or addressing emergency situations, irrespective of whether such entry occurs on designated housekeeping days. The guest acknowledges and agrees that such entry may be necessary and shall be permitted without prior notice in cases of emergency or statutory compliance requirements.
8. VALUABLES AND LOST PROPERTY
In the interest of security, guests are hereby advised to utilize the in-room safes provided by the Company for the safekeeping of their valuables. Any valuables and money, left unlocked and outside; company is not responsible for lost, damaged, or stolen personal items. With regard to lost property discovered on the premises, the Company shall implement the following protocol: all valuables and items containing personal information shall be promptly handed over to the jurisdictional police station. Other items of lost property shall be retained by the Company for a period of three months from the date of discovery, after which they shall be disposed of in accordance with applicable laws. Notwithstanding the foregoing, any perishable items, including but not limited to food, beverages, and other items subject to deterioration, shall be disposed of immediately upon discovery in the interest of hygiene and safety.
9. PAYMENT AND CHARGES
All charges for accommodation and services shall be settled in accordance with the Company's prevailing rates as applicable from time to time. The Company accepts payment through various modes including major credit cards, digital payment systems, bank transfers, and corporate credit accounts, provided that corporate credit facilities shall be subject to prior approval and execution of necessary documentation. The Company reserves the right to modify its accepted payment methods without prior notice. Room charges shall be applicable for the entire duration of the booking, irrespective of actual occupancy or utilization. Additional charges shall be levied for various services including, but not limited to, early check-in or late check-out facilities, accommodation of extra persons beyond the standard occupancy, any damage caused to Company property, and any additionalservices or amenities utilized during the stay. Such additional charges shall be communicated to the guest and shall be payable prior to check-out.
10. CANCELLATION AND REFUND
The terms governing cancellations and refunds shall be as specified in the Company's Cancellation and Refund Policy dated 04 February 2025, which document is incorporated herein by reference and shall form an integral part of these Terms. In cases where guests fail to arrive on the scheduled date of check-in without prior notice to the Company (hereinafter referred to as "no-show"), the applicable no-show charges shall be levied in accordance with the aforementioned policy.
11. COMPANY LIABILITY
The liability of the Company shall be strictly limited to direct damages arising from willful misconduct or gross negligence on the part of the Company or its employees. The Company hereby expressly disclaims all liability in respect of any loss, damage, or inconvenience arising from force majeure events, actions of third parties, guest negligence or misconduct, vehicle parking, internet service disruptions, or any losses exceeding the specified liability limits set forth herein.
12. DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the applicable laws of India. Any and all disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts situated in New Delhi. The parties hereto agree to attempt resolution of any disputes through good faith negotiations prior to initiating formal legal proceedings. Such negotiations shall be conducted in a spirit of mutual cooperation and with the objective of reaching an amicable settlement.
13. AMENDMENTS
The Company hereby reserves the right to amend, modify, or update these Terms at any time without prior notification to the guests. Such amendments shall become effective immediately upon being posted on the Company's official website. The continued use of the Company's services subsequent to any amendments shall constitute acceptance of the modified Terms by the guest. It shall be the responsibility of the guest to regularly review these Terms to remain informed of any modifications.
